General information

Aims of Course

This course will provide introduction into legal aspects of international trade and legislation system of European Union. Scope of the legislative aspects of this course are related to business administration of transport infrastructure and aviation. In addition, understanding of basics of contract drafting, mandatory content of contracts and legal necessity is the aim. Jurisdiction of trade relations and common failures due to contractual failures will be on scope. General approach to legal disputes and differences between court, arbitrage and mediation will be explained. Practical training of contract drafting will be available by this course.

Learning Outcomes

  • Understand principles of the contract drafting;
  • Understanding of aviation legal environment;
  • Recognize law application within international business environment;
  • Navigate in the legal system of European Union.

Short Course Content

  1. Definition of the international trade and basic regulation in aviation. Legislation of the European Union and definition of internal market.
  2. Role of law in aviation business.
  3. International law applications. (registration of commercial body in EU and aviation certification procedures).
  4. Soft law (INCOTERM, CISG, UNIDRIOT).
  5. Duties of the buyer (commercial vs. public). Duties of seller or service provider.
  6. Airline business model. Airport business model.
  7. Structure of contract and contract drafting. Aviation oversight (Ops., safety and security).
  8. Passenger rights.
  9. EU State aid regulations (airports and airlines).
  10. Force Majeure and options do declare contract void.
  11. Consequences of MOU.
